Baron Geisler files graft raps vs 3 DOJ execs

Actor Baron Geisler on Friday filed before the Office of the Ombudsman graft charges against three Department of Justice officials responsible for recommending the filing of acts of lasciviousness charges against him.

In a QTV Balitanghali report, GMA News' Alex Tinsay reported that Geisler went to the Office of the Ombudsman in Quezon City to personally file the complaints. He was accompanied by lawyer Bonifacio Alentajan.

Named as respondents in the charge sheet were Chief State Prosecutor Jovencito Zuño, Assistant Chief State Prosecutor Miguel Gudio, and State Prosecutor Amanda Felipe.

In the 14-page recommendation approved by Zuño, Felipe, who heads the investigating body, said Geisler should be charged with acts of lasciviousness before the Makati Regional Trial Court.

The DOJ had also dismissed the three counter-charges hurled by Geisler against victim Patrizha Maree Martinez; her celebrity mother Ma. Rosario “Yayo" Aguila; and family friend Steffanie Barrios.

Alentajan said the three prosecutors “abused" their authority and violated the provisions under the Anti-Graft and Corrupt Practices Act of 1992.

The actor’s lawyer insisted the DOJ could not recommend the filing of cases to a lower court. Geisler’s case stemmed from an April bar incident, where he allegedly invited the victim for sex and made lewd advances on her.

Alentajan said the prosecutors erred when they decided to recommended the filing of acts of lasciviousness charges against his client.

The lawyer said no element of forced threat or intimidation could be established, given that Fiamma Bar, where the incident happened, was reportedly packed at the time.

For his part, Geisler said the battle is not yet finished.

The actor also appealed to the public not to cast judgments about him as long as the issue has not yet been resolved.

As for the dismissal of the perjury and unjust vexation charges, Alentajan said the prosecutors do not have the authority to hand down such decision because it is only reserved to provincial or city courts.

DOJ recommends acts of lasciviousness case vs actor Baron Geisler

The Department of Justice has recommended the filing of criminal charges against actor Baron Frederick Von Geisler after establishing that there is probable cause to indict him for acts of lasciviousness.

In a 14-page joint resolution, Prosecution Attorney Amanda Felipe said that after consideration of the evidence presented, probable cause to indict Geisler for one count of acts of lasciviousness was established.

Felipe, meanwhile, dismissed Geisler’s complaint of unjust vexation filed against complainant Patrizha Maree Martinez and his complaint of perjury against Steffanie Ann Chua Barrios and Patrizha’s mother, actress Ma. Rosario “Yayo” Aguila-Martinez.

“After a careful and thoughtful consideration of the evidence presented in the above captioned cases, the undersigned investigating prosecutor finds that there is probable cause to indict Baron for acts of lasciviousness but no probable cause to indict Patrizha of unjust vexation, and Steffanie and Yayo for perjury,” said Felipe in the resolution which was approved by Chief State Prosecutor Jovencito Zuño.

In his complaint of unjust vexation against Patrizha, Geisler alleged that Patrizha’s act of rubbing her lips and tongue against his left ear tickled him and caused him annoyance, vexation, disturbance or irritation. As such, Geisler said he pushed Patrizha away, accidentally hitting her breasts with his hands and hurriedly left the bar. Geisler claimed that the night ended without any untoward incident. In her counter-affidavit, Patrizha denied Geisler’s allegations and maintained that the complaint of unjust vexation has no legal or factual basis “being a poor afterthought.”

The DOJ ruled in favor of Patrizha saying that the timing of the filing of Geisler’s unjust vexation complaint “casts serious doubts on the veracity of his allegations.” “The claim of Baron that Patrizha’s lips and tongue rubbed on his left ear, tickling him and causing him annoyance, irritation, vexation, or disturbance to his mind that was why he pushed Patrizha away, accidentally hitting her breasts with his hands is unbelievable and contrary to the statements he made in various television interviews regarding the said incident,” the DOJ said.

Geisler in his counter-affidavit, told the DOJ that it was Patrizha, whom he claimed to be intoxicated, as the one who wanted to be alone with him, and was the one who allegedly made advances on him on the night of April 25, inside the Fiama bar in Makati City.

Geisler, in his seven-page counter-affidavit, also asked the DOJ to dismiss the acts of lasciviousness complaint filed against him by Patrizha, daughter of actors Yayo Aguila and William Martinez.

“It was complainant who hugged respondent (Geisler) very tight, burying her chest into respondent’s abdomen and her face in the armpit, causing the latter terrible annoyance and irritation. Naturally complainant felt that her breasts was being touched,” Geisler said in his counter-affidavit. Geisler also claimed that the complainant rubbed her lips and tongue in his left ear, “causing him annoyance.” In the process, Geisler said he had accidentally hit the complainant’s breast with his hands when he tried to push her away. According to Geisler he then immediately left the bar after the incident.

Jodi says she's happy for Baron's revitalized career

Actress Jodi Sta. Maria, the former real and reel partner of controversial actor Baron Geisler, says that she's happy for Baron's blooming career.

"He's gone through so much in life and he's had so many intrigues thrown at him. What's important is that he's survived it all. He just hung on," Sta. Maria said during the premiere of her latest independent film "cul-de-sac."

Jodi and Baron played lovebirds in the hit youth-oriented show "Tabing Ilog", which launched the dramatic careers of John Lloyd Cruz, Kaye Abad, Paolo Contis, Desiree del Valle and Patrick Garcia.

Geisler gained notoriety after he was booted out of ABS-CBN's Pinoy Big Brother Celebrity Edition 2. He was also sued for acts of lasciviousness by Patricia Martinez, daughter of William Martinez and Yayo Aguila.

He recently bagged the best actor plum at the Cinemalaya Independent Film Festival for his effective portrayal of a manipulative homosexual program presenter in Francis Pasion’s debut film "Jay." Geisler is a cast member on ABS-CBN's newest television series "Eva Fonda."

For Jodi, who is now happily married to Senator Panfilo Lacson's son Pampi and mother to their son Thirdy, she only hopes that Geisler will continue to improve and change his life for the better. "Ang pagbabago ay tuloy tuloy lang niya at alam naman niya kung ano ang makakabuti at kung ano ang makakatulong sa kanya," the actress added.

Jodi is currently doing several showbiz projects mostly for independent producers.

Baron Geisler admits admiration for KC Concepcion

Controversial actor Baron Geisler has revealed his admiration for actress-singer KC Concepcion.

Geisler said that he would like to work and do a project with the Megastar's first child.

"Isa po siya sa pina-pangarap kong maka-trabaho... Dream girl ko po siya (cause) she's very spiritual... (a) God-fearing person," Geisler said.

Geisler said that he already met Concepcion and they sometimes send messages through SMS but nothing is serious about it.

"Text-text 'hi hello' pero nothing deeper than that," he said.

Yayo Aguila and family move on but still hope for good outcome on case against Baron Geisler

"Na-dismiss na raw ang kaso, which is not yet true.

May ipinaglalaban kami.

"We're hoping for a good outcome. At the same time, we have to move on," sabi pa ni Yayo.

Right niya yun, e.

"It's a universal thing. Honestly, hindi naman ako puwedeng magalit, e.

"Kahit sino, right nila yun. Yun din lang ang sasabihin mo, inaakusahan ko, hindi ka guilty. Ganoon lang yun," sabi pa ni Yayo.

TORN. Pero, aware si Yayo na wala siyang power para sabihin sa mga tao na definitely, guilty nga si Baron sa kasong isinampa nila laban dito.

"Kaya nga may hustisya. Para roon nga ma-prove, at maimbestigahan nga kung ano ang totoong nangyari.

"Hindi ako nagagalit, pero alam mo, hindi ko puwedeng sabihing hindi ako nagagalit, pero nagngingitngit ako.

"Pero, wala naman akong magagawa. At the same time, ang laki ng panghihinayang ko. Kasi, open book naman sa mga tao kung gaano kami naging close ni Baron," seryosong nasabi pa ni Yayo.

Parang anak na nga raw niya ang turing niya rito noong nasa Pinoy Big Brother Celebrity Edition pa sila noon.

"Maski ang family ko, alam nila kung gaano ako ka-close sa kanya," pagtatapat pa ni Yayo.

"I really, really treasure the friendship. But, again, something happened. It involves my family, 'tapos, anak ko pa. Isipin mo na lang kung ano ang kinalalagyan ko," dugtong pa niya.

Marami na nga raw nakakaabot sa kanya na sinasabi ng iba tungkol kay Baron, kasama na roon ang sinasabing atraso rin daw ni Baron kay Emilio Garcia noon, na may kinalaman din sa anak nitong huli.

"Sa akin naman, problema ni Baron yun sa iba. Pero, at the back of my mind, bakit sa anak ko pa niya ginawa yun, di ba? Mahirap talaga ang situwasyon ko," tuluy-tuloy na nasabi pa ni Yayo.

PUBLIC APOLOGY WILL DO.

Baron Geisler: 'I wasn't detained'

Controversial actor Baron Geisler has denied reports that he was detained in Venice early this month.

In a recent interview at Star Magic’s 2009 Catalogue Launch, Geisler deemed the reports as “foul” since he was in Europe with the cast of “Jay” when the issue surfaced.

“Jay,” an independent motion picture, was an entry in the Venice International Film Festival.

Although the film didn’t garner awards in the competition, Geisler was still happy as they have received a lot of positive feedback.

Geisler explained that they were set to be back in the country by Tuesday, September 2. However, he said that it was reset to Sunday, September 7 because they missed their original scheduled flight.

"There's no truth that I was detained. I just had a delayed flight because we missed our September 2 flight. That's why I arrived late," he said.

Geisler said that he cannot believe how his delayed flight to Manila would give birth to rumors that he was being detained in Venice.

"I just learned while I was in Venice that there's an issue here (in Manila) that I was inside the detention cell," he said.

Aside from the rumor, Geisler said that his delayed return to the country caused him another problem since he lost a big project with veteran actress Maricel Soriano.

He said that he was scheduled to work for the movie “Tenement” with Soriano on the first week of September. Since he failed to appear on time, his role was given to actor Eric Fructoso.

In the meantime, Geisler is finishing his shoot of “Baler,” a forthcoming film with Jericho Rosales and Anne Curtis. He is also set to be seen on “Eva Fonda,” an upcoming television series with sexy actress Cristine Reyes.

Baron snatched headlines when a sexual harassment case was filed against him by Patricia Martinez, daughter of celebrity couple William Martinez and Yayo Aguila.

DOJ set to decide on acts of lasciviousness charge vs actor Geisler

The Department of Justice (DOJ) is set to render a decision on the charge of acts of lasciviousness filed against movie and television actor Baron Geisler.

According to State Prosecutor Amando Felipe, fiscal-on-case, anytime this week his office will issue a decision regarding the criminal complaint filed by Patricia Martinez, the daughter of couple William Martinez and Yayo Aguila against Geisler.

Felipe said that her decision will be dependent on the sworn-affidavit and counter-affidavit of the complainant and the respondent, respectively.

The resolution will be submitted to Chief State Prosecutor Jovencito Zuno for approval.

The daughter of the Martinez couple filed a complaint with the PNP-CIDG (Philippine National Police-Criminal Investigation Detection Group) after the actor allegedly touched the private parts of her body in a bar in Makati City several months ago.

Geisler was reportedly drunk when he touched the breast of the complainant and whispered in her ear which he nearly bit.

The actor vehemently denied the allegations of Patricia. He also filed counter charges against the complainant.

Dionne reacts against all the unfair accusations against Baron

Amidst all the issues and intrigues surrounding Baron Geisler lately, one of his biggest pillars of strength is Pinoy Big Brother Season 2 alumni Dionne Monsanto, whom he's been steadily dating for several months now. Currently a full-time student at the University of the Philippines, Dionne finally speaks up about all the issues being thrown at Baron.

"I feel very sad, not just for Baron, but for his family and his very close friends as well. Right now I'm very close with his mom, who trusts me very much and I appreciate that trust. It's really sad because people can be very judgmental. "What they see on TV, that's what they think is the truth. Its disappointing to know that people just judge based on what's shown on TV and not really make an effort to know not just what the truth is, but to know more about it," she admits.

Dionne admits that Baron has been very mature and handling things well, choosing to focus more on his career than getting bogged down by the accusations against him. "He's taking it pretty well I have to say. His family supports him fully, most especially his mom. His mom is one great mom. She's a strong woman. She's very positive and good-natured," she adds.

Although she has not had the opportunity to accompany him to court because of her daily school schedule, Dionne says Baron knows she'll show her support any way she could. "I'm happy to be by his side during all these controversies because he says that I'm a good influence in his life right now. He says na when he's with me, he doesn't drink or think of doing things like that.

"He doesn't drink as much anymore. He still drinks but that's okay because I also think that when you try to get over a vice, you have to do it gradually. And I believe that he's doing a good job," she stresses. Although Dionne would rather steer clear of the spotlight when it comes to commenting on the actor’s harassment case, the former Lobo actress shares that the incident has not tested, but in fact strengthened their relationship.

"Kasi for me, above everything else, we're friends. And when a friend does something, you're not supposed to judge him. You're supposed to just be there and give him advice. You don't cease to become someone's friend just because he may or may not have done something wrong," she insists.

Dionne also trusts Baron this instance because she knows she understands him more than anybody else. "For me, he told me early on, in one of our talks, na I'm not like any other woman and I am special to him. Kaya when I heard what about what happened that night, I wasn't affected. I really didn't believe it," she concludes.

Baron on harassment case: ‘Sana matapos na’

Baron Geisler says he is keeping his hopes high that the harassment case filed against him would soon be over, which the actor admits, is quite a burden to him.

“Kahit papaano, nakaka-torture,” he begins. “Kasi parang tingin sa ‘yo ng ibang tao masama. Hindi mo naman masisisi ang ibang tao if they treat it as if mali ka talaga.”

The actor emphasized that he has no power over other people’s opinions but he finds comfort in knowing that there are fans, who still believes in him.

In a previous interview, Baron told ABS-CBN.COM that he is not a bad guy, but simply misunderstood.

“But I’m super happy,” Baron shares. “I secretly checked a blog, nagulat ako, andami pa rin ang naniniwala sa akin. I don’t want to brag, pero overwhelming kasi para sa akin.”

He said that if there is a particular lesson he learned from the entire experience, it is setting boundaries to “strangers.”

“May mga kakilala ako na isang text lang, punta agad ako, sometimes hindi kami close,” he explains. “Para hindi na ako ma-misunderstood, I think I should set boundaries o maglagay ng konting wall pag di ko kilala. I’m an extrovert, eh. I like being myself,” he said.

Patrizha Martinez, daughter of Yayo Aguila and William Martinez, filed a harassment case against Baron, accusing him of sexually harassing her in a bar in Makati a couple of months ago. Baron denied the allegation and filed an unjust vexation case against Patrizha.

Meanwhile Baron is set to do two new movies after winning Best Actor for portraying a gay TV producer at the recently concluded Cinemalaya Film Festival.

Baron Geisler: ‘I’m tired of the bad issues.

After winning the Best Actor award for his portrayal of a gay TV producer in indie film "Jay", Baron Geisler is optimistic about the two movie offers he’s recently received. The actor admitted that his acting recognition from Cinemalaya has attracted more substantial projects.

“I’m happy that after Jay nagkaroon ng interes ang mga movie producers to get me,” shared Baron.

According to the controversial actor, one of the movie offers is a horror flick under Star Cinema and the other is a Metro Manila Film Festival entry from Viva Films. Since these projects are still in the planning stages, Baron is keeping his fingers crossed that they would push through.

Nonetheless, even without these offers, Baron still has his hands full. He’s starring in the movie Torotot with Maui Taylor, Precious Adona and Yul Servo, which will be shown in cinemas this August 20.

He is also slated to appear in ABS-CBN’s upcoming soap, "Eva Fonda", starring Cristine Reyes. With these developments in his career, Baron is very focused on erasing his bad image from the public.

“Kilala ako na with a bad boy image, gusto ko lang baliin ‘yon. To tell people, ‘Hey im not a bad boy, I’m just misunderstood,’” he revealed. “I want all my publicities or lahat ng maisusulat sa akin good. Because I’m tired of the bad issues. I want to move on and become an actor.”

Baron not contented amid blessings

Baron Geisler's acting career progresses, his personal life keeps pulling him down. Baron was recently awarded as best actor by Cinemalaya in his remarkable performance in the independent film "Jay." He also keeps receiving positive remarks in his role in "Torotot" that will compete in Brussels Independent Film Festival.

Aside from movies, Baron is also part of the cast of upcoming ABS-CBN afternoon TV series "Eva Fonda" expected to start in September. "I feel great and happy because everybody around me congratulates me even people outside showbiz. So I am very glad with the compliments they are giving me. Those are my inspiration to work better," the actor said.

But despite all his success, he is still unsatisfied until he resolved his row with friend Yayo Aguila. Last Tuesday, during the hearing of acts of lasciviousness case filed against Baron, Martinez's camp rejected the out-of-court settlement offered by the young actor.

"It's too late for such a settlement offer. We believe that this is a good time to teach him (Geisler) a lesson and for him to realize that what he is doing is not good for him and for other people," the victim's lawyer Salvador Panelo said in a television interview. Baron who was not present during the hearing, was charged for allegedly touching sensitive part of the body of Martinez's 21-year-old daughter Patrizha Maree last April 25 at a bar in Makati.

Yayo's counter-affidavit in response to Geisler's countercharge of perjury against her and unjust vexation against Patrizhia was questioned because according to Baron's lawyer Bonifacio Alentajan it is "impossible" for Yayo to testify for daughter as she did not personally witness the incident.

Yayo was in the US when the alleged fondling incident happened. "In her sworn statement, she narrated what she heard from other people. She's not there. Her statement is purely based on hearsays meaning she is telling stories that she has no personal knowledge to," Alentajan said.

But Yayo contested that despite being away at that time, what she narrated in her statement were all true. "I'm not hurt. I'm not sad. It's just that enough for friendship for now," she said. But then for Baron, he still sticks to his counter-affidavit as a form of protection against people trying to destroy his reputation.

"My client has a right to protect himself and the only way he can do it is to file perjury case against her (Yayo)," Alentajan said. Baron also believed that he will not be receiving all his blessings at present if he really is totally a bad person. "I must be doing something right that's why God still blessed me. Maybe if I am a totally bad guy maybe God will not give me all these things. There are really many people whom we cannot convince not to be mad at me," he said.

Baron Geisler exposes “merchandise” in digital film

Actor Baron Geisler's movie in the ongoing Cinemalaya Independent Film Festival had people lining up at the Cultural Center of the Philippines as early as noontime, even though the film was set for a late night screening.

The film, director Francis Pasion’s "Jay," was already the most talked about movie of the festival.

The buzz was, Geisler would show his behind in the digital movie. True enough, he exposed not just his buttocks but his "merchandise" as well.

The actor said he had no difficulty carrying out his role.

"Hindi naman po ako nagkaroon ng second thoughts na gawin ang eksena na ‘yon. It was done tastefully naman po. Wala akong qualms na gawin ‘yon," said the actor of his controversial scene.

"Wala po sa akin ‘yon. Role lang naman po ‘yon. It’s okay po... Bahala na po sila kung ano ang isipin nila sa akin," he said.

Geisler plays a gay man in "Jay". Being a heterosexual male, he had to learn about getting into the psyche of a homosexual character.

He said that long before he started shooting for the film, he already learned a lot about gay characterization from mingling with homosexuals.

"I have a lot of gay friends. I observe them that’s why when this role was offered to me, I’m kinda already familiar with their actuations and translated them to the screen," he said.

Geisler said he does not expect to win an award for his performance.

"Para sa akin po, bonus ang nomination pero ang panalo, mas bonus pa," said the former Housemate of "Pinoy Big Brother Celebrity Edition".

Baron Geisler a 'gentleman' says ex-Wowowee host

At least one female has publicly come out in defense of actor Baron Geisler in the ongoing acts of lasciviousness case against him. She's former "Wowowee" host Janna Dominguez who swears that Geisler is a "gentleman".

Dominguez showed up on Wednesday at the Department of Justice preliminary investigation to attest to Geisler's being a "gentleman". She said that she's been a friend of the actor for a long time and can vouch for his proper treatment of women.

The plaintiff in the case, however, Patrizhia Martinez--daughter of actor William Martinez and actress Yayo Aguila--maintains that Geisler displayed no gentlemanly behavior toward her and even made lewd, sexual advances.

Accompanied by her lawyer Salvador Panelo, Martinez filed a counter-affidavit to the "unjust vexation" case filed against her by Geisler. The actor earlier filed the case to stop what he described as the baseless accusations of Martinez.

In her affidavit, Martinez maintained that the actor's complaint is without merit and stood firm on the acts of lasciviousness case she filed against Geisler.

Panelo also pointed out during the DOJ hearing that Geisler himself admitted to "practicing" his role as a sexual pervert (in his upcoming film, "Torotot") on Patrizhia.

The lawyer also told the DOJ that the actor was evicted from the Celebrity Edition of the Pinoy Big Brother reality TV show precisely because of sexual advances he made against his female housemates.

Baron Geisler turns table on daughter of William Martinez and Yayo Aguila

Ayon sa young actor, "Ako mahilig ako na kapag may bago akong role like bading, ginagawa ko to my friends and asking for their approval. Ito bagong role ko na manyak. Siguro she took it a wrong way. Di ba, parang kapamilya? So akala ko ay maiintindihan niya na naglalaro ako as a character. E, galing ako sa workshop, so yun lang."

Noong Biyernes, June 13, kasama ang kanilang abogado na si Atty. Panelo, nakuha ng mga Martinez ang kopya ng counter-affidavit ni Baron at pigil sila sa pagbibigay ng komento.

"Nairita siya [Baron]. May sexual advances daw si Patrizha. Kapal niya!" sabi ni Atty. Panelo.

Ayoko talaga mag-comment. She's okay, coping, thank you," pahayag ng aktres.

Baron Geisler Charged with Acts of Lasciviousness by Yayo & William’s Daughter

Patricia Martinez, the 21-year-old daughter of William Martinez and Yayo Aguila, filed a case against ex-PBB housemate Baron Geisler for “Acts of Lasciviousness.”

Baron and Patricia’s mom, Yayo Aguila, became housemates in Pinoy Big Brother Celebrity Edition 2.

Baron denied the accusations.

Baron reconciles with Kuya in Uber

Several days after Baron was forced evicted fromPBB, he gives his first interview today in Uber! And like most of us have set to do this new year, he also found his own resolution which involves embarking on a renewal program with the help of the show's very own resident psychiatrist Doc Randy. The actor says that he's willing to start afresh for the sake of his career. He still regrets the way he messed up his chance before but he remains optimistic that this is just another beginning for him.

More than his realizations, being able to hear Big Brother's voice again today certainly make things right for him. When he left last Thursday afternoon, he wasn't sure if the master of the famed yellow house had forgiven him for his transgressions.
